Topic 2: Tsokos' Pet Judge Removed by Supreme Court In another significant victory for the Caribbean Coast, Judge Anabel Omier was removed from the bench by the Disciplinary Committee of the Supreme Court. Omier, a personal friend of US citizen Peter Tsokos, who has been fraudulently claiming indigenous land in the Bluefields area and selling it on the internet, went too far for the Supreme Court when she jailed three policemen investigating the murder of Francisco Garcia. Garcia was a popular Bluefields businessman and educator who was married to indigenous rights lawyer Maria Luisa Acosta. He was murdered execution-style in their home, and it is widely believed that Acosta, who was out at the time, was the real target. Police investigation has confirmed that the prime suspect, Ivan Arguello, was Tsokos' chauffer, and that the gun used in the murder belonged to Tsokos' lawyer, Peter Martinez. Despite the evidence, Judge Omier had dismissed all charges against Tsokos and Martinez. The Nicaragua Emergency Response Network (NERN) has sent numerous letters to Nicaraguan officials, including to the Supreme Court, urging that the murderers of Francisco Garcia be brought to justice. An opinion, It seems that there are others who are claiming to "own" Islands and Indian lands in the Atlantic coast. Anyone claiming to be an adviser or owner should be looked at very close and more then likely are involved in a money scam. They do not care for the people of Nicaragua and offer anything from Beach lots to investments that never come about. More often then not, these people don't live in Nicaragua and have no respect for or from locals. As it is true you can buy property in Nicaragua in many areas from honest people who live there. You should visit for a couple of weeks and shed yourself of these "negotiators" and let the local people fill you in. Not only will you save thousands of dollars you will gain some new friends. Get out and meet some people offline! After all, if you are planning on buying a home or business why wouldn't you? Over the years, I have visited Nica and have met some very honest people who care about their neighbors. They speak more of a social level then business. This builds trust and develops unity in the town. There are good, kind, folks in Nica who welcome investment and require no fee. and YES clear titles, if you want to go of it on your own but stay away from that mess on the Atlantic. Great place to visit though !!! |

The ladder part of this post interests me greatly because it is correct and in more ways then one Very misleading.
Buying property in Nicaragua is a rather simple process If you are buying something in the range of 5 -10,000 U$ like Glen has been wanting to do. But if you are purchasing 200,000 properties and are doing it for an invewstment, then yes I think you could use the help of a qualified person that knows what he or she is doing, not some tourist guy that has been there once or twice. I have seen many people put money into something on a do it yourself senerio. They are been in more messes that you can imagin. Working on the cheap sometimes get in a world of trouble that you´d hope you would be given the chance to do over again. Según fuentes policiales, la banda primero ubica las tierras en las zonas con mayor precio y proyección de desarrollo. Luego investigan si el dueño está o no fuera del país y la situación registral del bien inmueble para proceder a cometer el delito mediante documentación falsa. OJO CON TITULOS SUPLETORIOS Cabe mencionar que por eso las autoridades judiciales ordenaron a los registradores del país no inscribir propiedades bajo el amparo de títulos supletorios en tanto no mostraren los interesados la correspondiente sentencia del juez civil. Las pesquisas al respecto se iniciaron inmediatamente después de que la representante legal de don Roberto José Vega Pereira, Geraldine Martínez Baca, denunciara el estelionato y la falsificación de documentos públicos (un título supletorio y aparentemente una sentencia del Juez Cuarto Civil de Distrito) y del que su cliente fue vÍctima. Vega Pereira, con testimonio de escritura pública de compra venta, demostró que desde 1967 es dueño de una propiedad de aproximadamente tres mil varas cuadradas, ubicada entre el kilómetro trece y medio y 14 de la Carretera Sur, pero para su sorpresa días atrás alguien ordenó la remoción de tierras en él. Al indagar qué pasaba don Roberto descubrió que su propiedad tenía un nuevo dueño: Marvin Aquiles Rodríguez Martínez, quien la adquirió por 42 mil córdobas de Flor de María Hernández Ramos. HAY MAS CASOS Otros dos compradores reclamaron la propiedad de don Roberto luego que este detuviera las labores de remoción de tierra iniciadas por Rodríguez Martínez, que compró de buena fe, pero al descubrir lo que estaba ocurriendo echó pie atrás en su compra. Según escritura elaborada por el notario Alejandro Aquiles Narváez, la señora Hernández mostró al abogado escriturante un título de dominio y posesión del bien inmueble, pero don Vega dice que nunca vendió a nadie su tierra para que ahora aparezca inscrita en el Registro de la Propiedad a nombre de otra persona que tiene un título supletorio a su favor. La abogada Geraldine Martínez demostró con constancia emitida por el responsable de archivo del Juzgado Cuarto Civil de Distrito de Managua, que en los libros de registros de entradas de demandas y copiador de sentencias del 2001, no existe registro alguno donde figure como parte solicitante de un título supletorio la señora Flor de María Hernández Ramos, mucho menos sentencia dictada a su favor. Hernández Ramos no pudo ser ubicada porque según su cédula de identidad vive en Carazo, pero la semana que viene deberá comparecer ante las autoridades policiales de la Estación Tres que investigan el caso para aclarar cómo aparece como dueña de la propiedad. El abogado y notario Alejandro Aquiles Narváez Pereira declaró ante las autoridades policiales de la Estación Tres este jueves y deslindó responsabilidades indicando que elaboró la escritura basado en el título de dominio y posesión que Hernández Ramos presentó. I would like to ad that it doesn't seem like the norm in Nica. It's just a very FEW that do these scamms. We have them in the US and you read about it everyday.
MOST people I met in Nica are very honest and want to provide a good service. Yes... if you plan to drop $200 grand USD on something then you best make sure you have some sound advice. When seeking a trail guide it's smart to pick one who knows the path. |

Very good advise
Not if you want get title insurance, You have to get Title Insurance. Unless your investment amount is not to much that if something went wrong, it would not break you.
Personally I do not understand why someone would choose NOT to purchase title Insurance..

I just got back from my last Nica trip about two weeks ago. It was GREAT !! We are building onto one of the orphanages and looking into two homes in Masaya.
We looked at maybe 15 homes and most had large yards with many fruit trees. None were over $25,000 USD. ALL have clear titles and there seems to be MANY others. We picked up a 6 bedroom with HUGE yard for $12,000 USD in town. There was an "adviser" who was selling it for the owners at $35,000 USD however, after talking to the true owners it was $12,000 USD. Took 30 min. for the price to drop and the true owners were kind and helpful. The lawyer in Nica does ALL the work. Lawyer did the papers and cleared it for $300 USD. Other properties, the owners were open to parnership for hotel, farming, you name it. Going on the cheap or going on the stupid take your choice. Money saved is money earned. Like one "advisor" on this site told me. "I love getting paid for doing nothing". I think we all can handle the do nothing part ouselves. Nothing has changed on the Atlantic and the land still belongs to the Native Peoples as it should be. Take care! and have fun on your house or business hunting! Glenn |
